High Court Sends Mass Eviction Case Back to NYC Housing Court
On June 3, 2008, in a disappointing setback for the tenants of 47 East 3rd St., The Court of Appeals, New York State's highest court, sent the five year old mass eviction case back to New York City Housing Court. The unanimous decision by the court's seven justices was silent regarding the tenants' main argument, but instead stated, '...we underscore that defendants may not recover the stabilized apartment units unless and until they establish in Civil Court...their good faith intention to recover possession of the subject apartments...'
The Case Continues to Have Broad Implications for the Future of Affordable Housing
The decision comes at a time when New York City has been loosing more and more of its stock of affordable housing. In a recent column in New York Metro, Neil deMause writes of the 47 East 3rd St tenants:
'...there's plenty of reason to care about their battle. The law in question addresses 'owner occupancy,' the right of a landlord to reclaim apartments for their own use. It goes on all the time with smaller buildings...accelerating the city housing crunch--turn a four-unit brownstone into a single-family dwelling and there's a ripple effect as your former tenants move out and displace still more renters.'
'David Pultz, who's lived at 47 East 3rd St. for three decades, notes the owner-occupancy provision is supposed to be temporary, with apartments returned to rent regulation once the owners move out; how this will happen once their floors have been ripped out to make way for a two-story-high ceiling is an open question.' Tenants Will Continue the Fight in Housing Court
As the high court ruling sends the mass eviction case back to where it originally started - in New York City Housing Court - tenants of 47 East 3rd St. will continue to fight what they see as an illegal demolition of rent regulated apartments under the guise of 'owner occupancy.'

Eminent Domain Legal Fight Heads to NY State Court

The United States Supreme Court denied the petition to grant a hearing (cert petition) to eleven property owners and tenants who asked the court to hear their appeal on the Second Circuit Court’s dismissal of their challenge to the use of eminent domain for Forest City Ratner’s Atlantic Yards development proposal in Prospect Heights, Brooklyn. The petition received serious consideration by the Court. In a rare statement accompanying the denial (it's unusual to have any statment at all when a petition is denied), Justice Alito said he would grant the petition. However, four Justices are required to accept the case.
The petition had asked the Court to address the appropriate constitutional limits on the government’s power to seize private homes for the benefit of powerful real estate developers like Bruce Ratner.
The Courts denial of the petition in Goldstein et al. v. Pataki et al. does not affirm or deny the plaintiffs arguments, and was not a ruling one way or the other on the plaintiffs' claims. And, it is not the end of the legal road for the plaintiffs.
The plaintiffs, fighting to prevent the seizure of their homes and businesses for the benefit of Forest City Ratner, will now pursue their eminent domain challenge in state court under New York State law.
"We are, of course, disappointed that the Court declined our request to hear this important case. This is not, however, a ruling on the merits of our claims. Our claims remain sound. New York State law, and the state constitution, prohibit the government from taking private homes and businesses simply because a powerful developer demands it. Yet, that is what has happened. Recent events have revealed that the public, and the Public Authorities Control Board were sold a bill of goods by Ratner and the Empire State Development Corporation. We now know that Ratners project will cost the public much more than it will ever receive," said lead attorney Matthew Brinckerhoff of Emery Celli Brinckerhoff & Abady LLP. "Now we will turn to the state courts to vindicate our rights. We will soon file an action in New York state court under state law as we were expressly permitted to do by the rulings of the federal courts."
Besides the eleven plaintiffs on Goldstein et al. v. Pataki et al. there are approximately 30 other residents and business owners in the projects footprint whose properties would be seized for Forest City Ratners benefit.
SO WHAT'S NEXT?
Now the plaintiffs will go to the state courts to vindicate their rights. They will soon file an action in New York state court under state law as the federal court rulings permitted them to do.

A new voice has emerged from the footprint -- a new blog called The Footprint Gazette.
Where is the borough president's and other elected officials' support and protection of the tenants living in (and around) the footprint chosen by Ratner for his land grab, as they are harassed every single day (and too many nights) by the utility work being done in anticipation of Atlantic Yards? City and state taxpayers fund that work, premature as it is.
The Footprint Gazette has been busy with the audiovisuals, posting this original song and video, "Get the Hell Off My Lawn," as well as a familiar plea, demanding: "Mr. Markowitz, Tear Down This Wall." The blogger does indeed have a great sense of humor for someone under daily assault by heavy machinery.
This past Friday the Gazette posted this instant classic; it is a must listen, a community opposition movement theme song--if you will--in the form of a musically remixed speech given at the May 3rd rally by Councilmember Letitia James: "Letitia James Gets Remixed." Please do go give it a listen...it will pump you up.
Now, unlike the carpenters union's video from Ratner's Rally in Support of Ratner, we did not have to pay a "professional" marketing firm to produce this stuff; it was produced by a person living in the footprint suffering (like all his neighbors in the area) day and night from work done by other trade unions (or non-union?), using taxpayer dollars for Forest City Ratner's boondoggle.
Homemade vs. pro-made--you decide which one is better. It's much like David and Goliath...and remember: David prevailed in the end.
