High Court Sends Mass Eviction Case Back to NYC Housing Court
In a dissapointing setback for the tennats of 47 East 3rd St., The Court of Appeals, New York State's highest court, sent the five year old mass eviction case back to New York City Housing Court. The unanimous decision by the court's seven justices was silent regarding the tenants' main argument, but instead stated, "...we underscore that defendants may not recover the stabilized apartment units unless and until they establish in Civil Court...their good faith intention to recover possession of the subject apartments..."
The Case Continues to Have Broad Implications for the Future of Affordable Housing
The decision comes at a time when New York City has been loosing more and more of its stock of affordable housing. In a recent column in New York Metro, Neil deMause writes of the 47 East 3rd St tenants:
"...there's plenty of reason to care about their battle. The law in question addresses "owner occupancy," the right of a landlord to reclaim apartments for their own use. It goes on all the time with smaller buildings...accelerating the city housing crunch--turn a four-unit brownstone into a single-family dwelling and there's a ripple effect as your former tenants move out and displace still more renters."
"David Pultz, who's lived at 47 East 3rd St. for three decades, notes the owner-occupancy provision is supposed to be temporary, with apartments returned to rent regulation once the owners move out; how this will happen once their floors have been ripped out to make way for a two-story-high ceiling is an open question." Tenants Will Continue the Fight in Housing Court
As the high court ruling sends the mass eviction case back to where it originally started - in New York City Housing Court - tenants of 47 East 3rd St. will continue to fight what they see as an illegal demolition of rent regulated apartments under the guise of "owner occupancy."
