Each year, 8,000 city employees — including City Council members — must file reports disclosing all outside income of $1,000 or more per year. On the disclosure forms she filed from 2009 through 2012, Mark-Viverito claimed she received no such income.
Any intentional misstatement of assets and liabilities can subject the filer to a civil penalty up to $10,000.
Mark-Viverito did report receiving “apartment rental” income of $5,000 to $34,999 in 2007 and 2008, but it’s not clear if that income came from her East Harlem units or condos she co-owns in Puerto Rico.
From 2009 to 2012, three people other than Mark-Viverito have voted while listing the building as their principal residence, Board of Elections records show. Yet, in each of those years, Mark-Viverito reported on her city financial disclosure forms that she received no rental income from the property."
