We submit this letter as a supplement to our argument, on Page 4 of the Reply Memorandum in Support of the Sentencing Submission on Behalf of Gerard Denault, that the government has failed to establish a loss of over $100 million. As explained in the reply memorandum, the government's reliance on mark-up calculations cannot establish accurate loss calculations. As discussed in our submission, the CityTime contract provided that SAIC would bill the City at the labor category rates specified in the contract for consultants regardless of whether those consultants were its own employees or subcontractors. The contract did not include a provision that would limit SAIC's mark-up or require SAIC to pass any savings on to the City that it gained by having subcontractors perform work on the contract. This arrangement was consistent with other large IT service contracts with the City. 
Attached to this letter, we submit two recent New York City audits of large IT projects, which demonstrate that the government's claim that the City was defrauded by SAIC's markups is inconsistent with other large IT service contracts that, like SAIC's, did not limit contractor's markups or require the contractor pass any savings on to the City that it gained by having subcontractors perform work on the contract. The first is a September 2013 audit of Accenture's Access NYC Contract with the City. Under the Accenture contract, Accenture "added a significant imputed mark-up on services provided by its subcontractors with a mark-up rate as high as 178 percent." For the contract period, Accenture alone (without consideration of any additional markup added by its subcontractor) had an "average mark-up rate of nearly 58 percent" and during the year 2012 there was an "average mark-up of 84 percent." "Securities Litigation

Between February and April 2012, alleged stockholders filed three putative securities class actions. One case was withdrawn and two cases were consolidated in the U.S. District Court for the Southern District of New York in In Re: SAIC, Inc. Securities Litigation. The consolidated securities complaint named as defendants the Company, a former chief financial officer, two former chief executive officers, a former group president and the former program manager on the Company's contract to develop and implement an automated time and attendance and workforce management system for certain agencies of the City of New York ("CityTime"), and was filed purportedly on behalf of all purchasers of the Company's common stock from April 11, 2007, through September 1, 2011. The consolidated securities complaint asserted claims under Sections 10(b) and 20(a) of the Securities Exchange Act of 1934 based on allegations that the Company and individual defendants made misleading statements or omissions about the Company’s revenues, operating income and internal controls in connection with disclosures relating to the CityTime project. The plaintiffs sought to recover from the Company and the individual defendants an unspecified amount of damages class members allegedly incurred by buying Leidos' stock at an inflated price. On October 1, 2013, the District Court dismissed many claims in the complaint with prejudice and on January 30, 2014, the District Court entered an order dismissing all remaining claims with prejudice and without leave to replead. The plaintiffs moved to vacate the District Court's judgment or obtain relief from the judgment and for leave to file an amended complaint. On September 30, 2014, the District Court denied plaintiffs' motions. The plaintiffs then appealed to the United States Court of Appeals for the Second Circuit. On March 29, 2016, the Second Circuit issued an opinion affirming in part, and vacating in part, the District Court's ruling. In particular, the Second Circuit held that the plaintiffs should be permitted to pursue omissions claims against the Company with respect to the annual report the Company filed on Form 10-K on March 25, 2011; the Second Circuit affirmed dismissal of all other claims, including all the claims against the individual defendants. The Company has petitioned the Second Circuit to rehear the appeal, and the petition is pending."

Robins Geller is the  lead law firm that represents  SAIC (now LEIDOS) shareholders lawsuit. In a class action lawsuit Shareholder's are suing SAIC for not reflecting the CityTime Loss on it's SEC (Security and Exchange Commission) filings for March 2011.  Robins Geller is holding hard in its court correspondence yesterday that SAIC deliberately failed to disclose  its CityTime project loss "JUST" a month before they fire Denault, 2 months after the initial indictment, TIGHT...TIME FRAME.  The street concurs this is BS.  According to Robin Geller court letter,  repeated attempts by SAIC to have SEC violations dismissed for lack of knowledge is just not so.  The Street thinks SAIC will finally have to pay up not slip out!? More losses? CityTime Curse... to be continued.

News flash...Wonder Woman is seeking Technodyne i.e. Padma and Reddy Allens the two "others" that fled the US upon CityTime  indictment number one.
