Notification issued 6/23/10 at 2:25 PM. The US geological Survey is reporting a 5.5 magnitude earthquake near Southern Ontario, Canada. The affects have been felt in the New York City area. There are no reports of injuries or damage in New York City at this time.

Giuseppi Logan is playing the piano in Tompkins Square Park. The piano is there as part of a program called "Arts Activism in Action."  Volunteer, Gary Newton unlocked the piano so Giuseppi Logan could play.  I am told GL played the bag pipes, flute, sax, clarinet and piano.

He told me he wished he had a piano in his home.

Right now we can't even get his phone up and working.  Hope to have that resolved soon.

I saw this elderly man with a cane standing in this heat hoping to get a cab.  Unfortunately there was a very pretty blonde woman in front of him.   I pointed him out to her and she agreed to give up her cab but in the second I turned my head to the older man another pretty blonde hoped in.

I pointed the elderly man out to Blonde no. 2 and she agreed to get out and than I made sure this senior got in the cab.

Alicia passes away

Dear Readers: I met Alicia when Frank adopted her and she was very blind and Frank very devoted. She was very loving and I had some quality time with her. Rest in Peace.

This is the same Frank that gave me "stuff" for 47 East 3rd Street when they were trying to raise money for their lawyers fee with a table outside their home were they were finally evicted and this is the same Frank who gave me clothes for a homeless man that would constant be in a terrible state and need fresh clothes.

His devotion to Alicia, a late in life adopted handicap dog was very moving.

Dear Friends:

My sweet little Aquarian, Alicia Sophia, a blind Italian Greyhound rescue from the internet, passed this morning at an emergency care veterinary hospital. Inspired by my friend Mark's two beautiful Iggys, I searched Google one evening to see if there was an abandoned Iggy in need of a loving home. The search brought me to The Italian Greyhound Rescue Network and there was a picture of this blind Iggy in a foster home. I instantly knew we were meant to be family. She arrived two weeks later from New Jersey, a special needs adoption. She had been abandoned in Virginia Beach, VA two years before, left at a vet's office. She went into the foster care loop for two years. She was 7 years old then and had an enlarged heart, failing teeth, pulmonary edema, and mitral valve prolapse.

Because she was blind with cataracts, my two recently rescued Maine Coon Tabby sisters accepted her immediately into the family as no threat to them, just as they had been accepted a few months earlier by Sally Ann, my 9 year old red-eared slider turtle, who had been abandoned in the building garden when only a month old.

Alicia had been with me for only 18 months when, in March, her health began to decline with a chronic cough. Two of my clients had alerted me to the fact that they knew that cough to be an enlarged heart pressing on her esophagus. She was diagnosed as such and began 4 medications twice per day. She was stable until the day after Father's Day which was a delightful day of gratitude for all being together. I had some really wonderful play time with each of them and remember thinking how wonderfully loving and playful Alicia was on Sunday. Monday morning I heard her yelp and found her in a spastic fit that lasted several minutes. As I rushed her to the emergency care hospital, she had another seizure in my arms, only this time she was crying out for me to help her. A plan was developed and she went into ICU immediately.

At 7 pm last night, I was allowed to visit her for ten minutes and she looked like an angel resting peacefully in her cage all hooked up to something or other. I spent that time telling her how amazed I was that she survived the heart attack and how special she is to me. I held her and kissed her sweetly on her nose, knowing how she liked that. She was to be released on Wednesday.

This morning she had two additional seizures in ICU and I received the call that she was not doing well. At 10 am I received a second call that she had not improved and what decision had I made? I spent the last few minutes with her as she received her injections telling her all the things a Dad tells his beloved kid knowing she would soon be gone. I had never done this before. I have never had the courage to hold a pet as it was being given a final injection but Rudy, my last cat, died at home with me and I thought I would not survive it, it was so very, very painful. This prepared me for Alicia's death today and am so thankful to Rudy for teaching me that I was strong enough to say goodbye and live through it.

Alicia could not see me this morning but she felt me and heard me and I could feel it in her heartbeat every time I told her I love her. I kept my hand on her chest until it stopped beating and only then did I break into great weeping and deep sorrow. She was a very gentle and loving creature, she was very dear to me.

Cy Vance's Campaign treasurer called me back very compelling.

I was very impressed with the gentleman that called me back.  I was impressed and what he told me is on the NY Board of election web site.  Cy Vance is paying back a debt to Guma.  Everything is legal and above board.

As far as Keaney -- she pops up allegedly working with Haggerty, in an article slamming Christine Quinn and Maura Keaney for alleged intimidation of Union people and married to Guma so it is campaign incest in my opinion   and it does appear that a lot in NY politics is incestuous but the part about money and Vance's campaign debt is legit at least so far.   Look at Albany with the accidental gov and his father Basil and unions -- very incestuous and in my opinion a conflict of interest and NYC is riddled with conflicts of interests that seem to get by the Conflict of Interest Committee.

I am not going to dismiss everything that was sent to me yet but I am glad to get a call back from Cy Vance's campaign treasurer.

He was barely sitting up inside the Cooper Square Park behind Cooper Union on dirt sprayed with pesticides.

He was wearing what looked like hospital wear, middle aged and in bad shape.  I asked him if he needed help.  He said to call 911.  I asked do you want to go to the hospital and he said, yes.

Will Attorney General Andrew Cuomo Appoint a Special Prosecutor?

It’s not surprising that Manhattan District Attorney Cyrus Vance went easy on Mayor Mike Bloomberg in the current pay-to-play scandal involving a personal donation Bloomberg made to the New York State Independence Party. The minor Party has received considerable attention in recent months as the apparent conduit in a plan for the hiring of John Haggerty, Jr., consultant and friend of Mayor Bloomberg’s. The DA alleges that Haggerty misspent the funds, meanwhile by all accounts, it was Bloomberg’s operatives and staff, who allegedly arranged for the large donation and Haggerty’s hiring.

The matter presents unprecedented complications for the Mayor’s Office, which controls the lion’s share of the District Attorney’s budget, and for Cyrus Vance who is embroiled in his own potential campaign finance scandal concerning allegations that he evaded the legal limits placed on corporate donations. The Cyrus Vance for District Attorney campaign has written off $96,172 of a $273,349 debt owed to Mark Guma Communications, LLC through an apparent debt forgiveness agreement.

Meanwhile, Guma’s wife, Maura Keaney, was Bloomberg’s Director of Field Operations in his 2009 bid for a third term. In February 2010, just as the scandal broke in the New York Post, she was removed from the campaign payroll and given a lucrative position in the Bloomberg Administration around the same time that Deputy Mayor Kevin Sheekey moved over to Bloomberg, LLC. As a side note, Keaney was formally Manhattan Council Speaker Christine Quinn’s Deputy Chief of Staff who left the position under a dark cloud, and was later fined by the City’s Conflict of Interests Board for soliciting campaign contributions for Quinn on City time. The New York Times has also reported that Keaney received a $150,000 bonus from Bloomberg following the Mayor’s 2009 election.

In the incestuous world of New York City politics, sources indicate that John Catsimatidis, a close friend of Queens Borough Republican Chairman Phil Regusa and Vice-Chairman Vince Tabone, known to be sworn enemies of John Haggerty, Jr., is planning a fundraising event for Cyrus Vance who is now in a race to clean up the debt to Guma.

The planned fundraiser was first reported by Liz Benjamin in Capital Tonight and most recently by Adam Lisberg of the Daily News. No word yet if he will cancel the event in light of the recent campaign finance indiscretions. Even if Vance does repay Guma, the damage has already been done.

The debt according to New York State campaign finance law had to be repaid prior to the end of the 2009 election cycle or it defaults to ‘contribution’ status. In campaign Finance filings reported to the State Board of Elections, Vance already wrote off the debt by reporting the Guma Communications’ bills to the campaign as contributions. The purported actions may be considered class e felonies.

The Question of the Day in New York’s scandal-ridden rumor mill is if Attorney General Andrew Cuomo, who has jurisdiction in such matters, will engage his own investigators or call on a Special Prosecutor to look into Vance’s campaign finance indiscretions.
Even a misdeamor charge for Cy Vance related to the campaign finance violations may end his career. Any attorney admitted to the Bar in Manhattan would lose their law license if charged with even a misdemeanor, and a felony charge most certainly end in Vance's resignation.
Vance’s formidable and former opponent in the New York for DA Democratic Primary, Leslie Crocker Snyder, may also have a beef with the Vance campaign when all is said and done. Vance failed report one of the shady donations from Guma until after the primary ended, waiting instead until January 15th.

At first blush the campaign may have accepted accepted the money from Guma in a desparate attempt to garner campaign favors and cash to win at all costs. But Vance, an apparent expert in campaign finance matters, must have known the implications of the crafty filings.
It wasn't too long ago that the tables were turned: Cyrus Vance enjoyed a long and lucrative career as an attorney in Seattle, Washington where he once representated Food Services of America in a high-profile case before before United States Magistrate Judge John L. Weinberg, for making $5 million dollars in illegal campaign donations to the Republican Party. The CEO and CFO of Food Services of America were both found guilty in the case, as was the corporation. Upon the verdict, Vance reportedly commented, "The atmosphere of campaign-financing-related cases has changed dramatically in the past several years. It is now prosecuted as a criminal violation, whereas only two years ago it would have been handled as a civil fine."


Now back in New York, Andrew Cuomo may have tell us all how the story goes will end for Manhattan District Attorney Cyrus Vance, Jr.

Points of Public Interest pertaining to Cy Vance’s Campaign Finance Irregularities in collusion with Michael Bloomberg’s campaign and Mark Guma Communications.

· Cy Vance has a longstanding debt to Mark Guma Communications for $273,349 to whom he paid more than 1.1 million dollars to for consulting and electioneering activities from September 2009-January 2010.

· On January 15, 2010, Cy Vance mysteriously reported to the State Board of Elections that he had loan/liabilities to Mark Guma Communications in the amount of $273K that dated back to 9/14/2009. (2009 10 Day Post Primary)

· In a series of shady campaign finance maneuvers reported on campaign filings throughout the 2009 election cycle, Cy Vance has apparently attempted to conceal the fact that Mark Guma has forgiven large sums of debt owed to Mark Guma Communications, Inc. previously invoiced to Cy Vance’s campaign.

· In a series of campaign finance reports, Cy Vance’s campaign reduced their liability to Mark Guma Communications, Inc. by reporting campaign expenditures on section F of their filings (with corresponding check numbers) purportedly written to Mark Guma Communications, while simultaneously reporting on Section O of his finance reports that Mark Guma was making a donation to the campaign for the same amount.

· Vance’s campaign simultaneously reduced the liabilities in section N of its filings by the exact same amounts of each “donation” reported on section O.

· Thus far, $96,172.85 in debt owed to Mark Guma Communications, Inc has been “written off” by the Cy Vance campaign in a subversive manner, and thereby evading campaign finance limits placed on corporate donations.

· (Section 14 of Election Law)The New York State Board of Elections has ruled that a company or corporation that engages in public relations does not typically lend money to its clients. Therefore, “any loan by the company which is not repaid by the date of the election would be deemed a contribution in accordance with the provisions of the law. If the amount not repaid to the corporation on the date of the election exceeds $5000, the corporation would be in violation of section 14 of Election Law which limits corporate contributions to $5000.” (NYS BOE 1977 Opinion #8)

· In addition, if the company extends credit to a campaign for services performed, with the INTENT to eventually write off the debt, this is considered an act to violate and evade the contribution limits set forth in section 14 of Election Law. (NYS BOE 1977 Opinion #8)

· Section 14-126 of State Election Law clearly states that (3) Any person who knowingly and willfully contributes, accepts or aids or participates in the acceptance of a contribution in an amount exceeding an applicable maximum specified in this article shall be guilty of a misdemeanor.

· Section 14-126 of State Election Law clearly states that (4) Any person who shall, acting on behalf of a candidate or political committee, knowingly and willfully …makes expenditures in connection with a nomination for election of any candidate, or solicits any person to make any such expenditures, for the purpose of evading the contribution limitations of this article, shall be guilty of a class E felony.

· Of further consideration, and perhaps more intriguing, is the fact that Mark Guma is married to Maura Keaney, Mike Bloomberg’s Field Operations Director for the 2009 mayoral race. Keaney worked with John Haggerty and was allegedly involved in the Election Day poll operations and planning that has come to light in recent weeks that involved alleged criminal activities.

· Keaney was moved out of her job with the campaign committee in February, around the same time the NY Post began reporting Haggerty’s enormous Election Day pay-off.

· It seems that Cy Vance was receiving his big pay-day from Mark Guma Communications, Inc.

Governor Paterson has until midnight to sign or veto the Loft Law. His staff reports that no decision has been made on whether to sign or veto, and the administration of Mayor Mike Bloombucks has issued a formal memo asking for a veto.

Call, fax or email the Governor. Urge him to sign this bill!

A5667-C expands coverage of the Loft Law to protect tenants who moved into illegal loft dwellings in recent years (the current law protects only tenants who have lived in their lofts for 30 years or longer). The bill also makes the Loft Law permanent.

The Loft Law gives rent and eviction protections to tenants who are otherwise uncovered by the rent laws. These are units in manufacturing or commercial buildings that are not zoned for residential use – but many landlords have nevertheless rented them to people who are desperate for a place to live. The Loft Law provides a mechanism for these buildings to be legalized – brought up to fire and safety codes – while preventing the landlords from evicting the tenants. Once the building is legalized, the apartments go into rent stabilization.
As strange as it may seem, Governor David Paterson, known as a pro-tenant legislator during his years in the Senate, is still threatening a veto of the 2010 Loft Law. He has to act today – by midnight.

New York City is still protesting the areas that are covered, the number of units required, and other points. The loft tenants’ position is that the Governor should sign the bill and let the Loft Board sort things out. The City had years to address this situation and failed to do so.

Ask Governor Paterson to do the right thing and sign the 2010 Loft Law.

NYU uses the term "community facility" to bust through zoning and blot out the light and beauty of what was the Village, East and West also causing mass displacement, tearing down our historic buildings like St. Ann's at 120 East 12th Street as well as the Poe House and Province Town Play House to name a few.  I went to bed in the East Village and woke up on a bad xerox of mid-town turning in to a bad xerox of Dubai.  NYU has zero respect for the community because they want the community to move out to make room for their unending need to expand.  Check how many infrastructure related breaks we have had around all the NYU mega dorms in the East Village.  John Sexton ran down to City Hall to testify king Mike must have a third term (and be allowed to deny the people a referendum) and why?  Because of greedy community crushing development where ever NYU, the purple reign of terror occupies real estate.  John Sexton and his zone busting NYU uses their status as not for profit as a tax shelter.  I even wrote State Attorney General asking if NYU, Columbia University and Cooper Union's real estate dealings could be investigated under anti-trust violations since they act as a monopoly.  An investigation in to NYU's expansion and NYU great harm and costs to neighborhoods needs to be investigated.  Did NYU remove the fire hazard extra walls they installed in Stuy Town units that was meant to be affordable housing not NYU housing?  Can John Sexton even vote here in NYC?  Is John Sexton a NY resident?  John Sexton has zero respect for the community and for democracy which Sexton proved when he ran down to City Hall to say the mayor that caters to real estate developers must have a third term and Sexton is paid 1.8 million and that doesn't include his real estate digs courtesy of NYU.   The only thing John Sexton, Amanda the peoples Burden, a socialite mega millionaire city planner and caterer to developers at the communities' expense Mike Bloombucks have not done is provide NYU buses and trolleys to move the people that made the neighborhood so desirable out.

I lived next to St. Ann's 120 East 12th St. for 20 years.  The USPS sold the air rights to NYU with out notifying the State of NY as legally required but like blocking the fire hydrants the USPS was and is confident they are above the  law.  The State of NY would have examined is this in the best interest of the community but NYU and the USPS did not care about the community -- only about their greedy agendas.  I will never forget the parisoshners praying and crying on the street.
St. Ann's survived everything all these years from 1847 until NYU's greed and need to build yet another mega dorm.  NYU mega dormed the East Village to death.  Than came New School, NY Law, SVA and Cooper Union mega dorms and than zone busting hotels and bars and banks to cater to NYU-ville. In the mean time more displacement and evictions.  Even landlords want shorter leases and cater to transient student population allowing them to raise the rents even more do to turn over.

My office tends to be the streets of NYC so I called his office and was directed to the press office.


I explained I was sent info which I posted and I wanted to hear his side of the story....

I was told he spent 1.1 million on his campaign and I round off to a quarter million explaining I don't have the exact figure handy but is it true that Cy Vance's campaign manager dismissed close to a 1/4 million owed and that the campaign manager is married to Maura Keaney who was written up in The New York Times in a piece by Jim Dwyer re: Christine Quinn and Keaney involved in intimidation of Unions as I recall and is the same Keaney who worked with Haggerty.

I directed his rep to my blog and YouTube.

I left my cel number.

Remember when I called City Hall and the guy that answers Mike Bloomberg's telephones was as warm as Mike Bloomberg when you ask Mike about the poor, his investments in the Cayman Islands and his long weekends in Bermuda.....

So I called his private empire and left a message for his press woman about the ads on the steps of Grand Central instructing New Yorkers to "Think Bloomberg".   I wanted her to answer questions on how much the ad cost and did it also represent him politically as well as business wise?

Mike wants to push population growth and make the East Village a college campus party central.
This garbage can is a metaphor for Mike Bloomberg's reckless arrogant greedy corrupt "new" hideous New York built on old New York's infrastructures.

E. Village intersection that DEP can't seem to fix

My opinion is Cooper Union's supersizing of their Studio building caused this medium size water main break that looked like the East River came to 2nd Avenue.

To be responsible the mayor would have had to insisted all old pipes would have had to be replaced and expansion pipes addressed before all these over the top builds began but greed and speed are important when you are exploiting the people and the neighborhoods and no way was NYU, Cooper Union and all these hotel and condo developers going to slow down for the safety of the neighborhood and that includes the illegal air sale by the USPS to NYU at 120 East 12th St. over St. Ann's Church.


Medium sized water main break right at this intersection that continues to be a mess and DOT wants to pave the street but the infrastructure problems are not resolves.

Sept.  6, 2008 the street busts open yet again.

(note in the above photo you can see the sky piercing mirrored building -- that is one of Cooper Union's shady zone busted builds.  It was a parking lot that Cooper Union old but got permission from Amanda the people's Burden to supersize and than land lease the building -- from what I gather not many people want to pay high prices for a condo on land that is leased....I don't know -- you tell me.)

Here is the same intersection today -- Mike Bloomberg's streets of New York.  Trying being a senior, handicap, a parent with a baby stroller, someone like me with bad knees trying to cross or even walk on the sidewalks.  It is a huge mess.

DOT is attempting to pave over the streets but it is like someone getting liposuction and not changing their eating habits.

The infrastructure problems have to be addressed.

DOT will be back having to repair the streets they are now repaving.

Con Ed letting off steam Father's Day

Mike Bloomberg will be remembered for recklessly pushing a tsunami of development on old New York's infrastructure and displacing as well as endangering New Yorkers.

Everybody that could including Con Ed should have said slow down.

Con Ed bills continue to rise and my theory is the people are being forced to absorb the infrastructure expansion by Con Ed for mega dorms, luxury hotels, sky piercing condos, and building like Cooper Unions where they use their not for profit status to bust through zoning to be a  real estate magnate landlord.

IPad how the E. Village has changed

The New York Post reports that bold thieves steal boxes right in front of the Apple Store on the Upper West Side.

To illustrate how much the East Village has changed I am told that very trusting people in the East Village leave their IPads right on the tables of outdoor cafes and so far no one has stolen them.

Many years ago in the morning on St. Marks right by Tompkins a young man attempted to grab my walkman out of my hand quite roughly but he failed.  My walkman had a strap and I help on tight and called him a /////   /////.    It seemed like some kind of thug initiation because his friend was across the street watching.

You can't leave your bags or an Ipad on a table when you go to the bathroom.  You can't be that trusting or foolish.
